    THIRD BANK IN WAHOO CLOSES

RUN CAUSES CITIZENS STATE TO SUPSPEND OPERATION

Largely because of the psychological effect of two other bank failures in the same town and four in neighboring towns of Saunders county, the Citizen's State bank of Wahoo found it necessary to suspend business Thursday morning. When it fad to open its doors the institution was taken over by the state banking bureau, which had been notified, and Examiner L. C. Sorensen assumed charge of it.
Heavy withdrawals followed the closing of the six Kirchman banks earlier in the week are assigned by Cashier Emil Benson of the Citizen's State as the cause of its inability to continue business. About $50,000 was pulled out by depositors onnesday, he declared.
Mr. Benson thought the bank's affairs are in such shape that it will pay depositors a good percentage of their claims. He would venture no prediction as the whether its reorganization will be attempted.
The Citizens' State was organized thirty-five years ago. Mr. Benson, who has been connected with it for 18 years, was actively in charge as cashier for several years past. He is also vice president. J. M. Ohslund has been its president for at 12 years. The assistant cashier was Adolph Kucera.
Deposits on March 31, the date of the bank's last published statement, stood at $403, 986, but this amount had been greatly reduced by withdrawals since.
State Bank Commissioner Woods declined to make any statement regarding plans for reorganizing any of the seven banks closed in Saunders county this week.
Thursday's failure leaves Wahoo, one of the principal; county seat towns in eastern Nebraska, without a single state bank. It has one national bank.

NOTES EXCHANGED BY WAHOO BANKS OFFICIALS CLAIM

Prosecution of two Wahoo bankers, F. J. Kirchman and Emil Benson, the latter of whom is now in the penitentiary after pleading guilty on Wednesday to three criminal counts, and the former is being held for trial in the United States districtrt on fifteen speculations followed a simultaneous examination of all the banks in the Kirchman string last week, which uncovered a system of exchanging notes and credits with the evident purpose of deceiving the examiners.
It was found that Benson, whose bank did not belong to the Kirchman group, had loaned $6,000 of notes from his institution to Kirchman's bank in Wahoo at the time it was undergoing examination. These were returned upon the order of State Bang Commissioner Woods.
Five examiners for the state and one national examiner swooped down at once upon the banks that were subsequently closed. They uncovered a number of items which had apparently been transferred back and forth among the banks, and in some instas entered as credits on the books of two different institutions at the same time.
Mortgages belonging to customers of the Benson bank, it is stated, had been turned into the bank to help it make a good showing for the examiners scrutiny.
Bank Commissioner Woods will hold a series of depositors' meetings in the various towns where the banks were located on Friday and Saturday, to consider their reorganization.
Emil Benson, vice president and cashier of the Citizens State bank of Wahoo which closed last Thursday, began his clerical duties in the factory office at the state penitentiary this morning.
He was brought to the prison Wednesday evening by Sheriff L. D. Mengel and County Attorney C. F. Galloway of Wahoo to begin serving a term of five to ten years.
Benson was sentenced late Wednesday afternoon by District Judge Hastings after he pleaded guilty to three charges of embezzlement.
County Attorney Galloway declared at 2:30 o'clock Wednesday afternoon that no complaint had been drawn against Benson and said that to his knowledge none was contemplated.

    WAHOO BANKER COMES TO PEN

EMIL BENSON PLEADS GUILTY TO VIOLATING BANKING LAW

    F. J. KIRCHMAN GIVES BOND BEFORE FEDERAL COMMISIONER IN OMAHA

OMAHA, April 24 - AP - One Wahoo banker began today a long term in the Nebraska penitentiary at Lincoln and a second faces federal prosecution on a charge of misappropriation of funds as the result of the closing last week of several Saundersunty banks.
Emil Benson, vice president of the Citizens' State bank of Wahoo which closed last Thursday, was taken to Lincoln last night to begin serving from five to ten years term on each of three counts to which he pleaded guilty yesterday in Districturt. The sentences which will run concurrently were accompanied by fines of $1,000 on each count.
    KIRCHMAN FREED ON BOND
For 45 years connected with the Saunders County National Bank in which he started as a janitor, F. J. Kirchman, Sr., 64, president of the institution has been arraigned before United States Commissioner Mullen and released on a charge of misaication, after $5,000 bond was filed by one of the depositors in his bank.
Kirchman is charged with having misapplied funds and making false entries in actions involving $48,000. He also owns interests in five of the Saunders county state banks which closed last week.
    BENSON PLEADS GUILTY
Benson whose bank was taken over by the state banking department last Thursday admitted before District Judge Hastings at Wahoo yesterday that he had made out three notes totaling $9,100 in favor of the bank, to replace two notes and a mortge which had been placed in the bank for safekeeping. The notes were recorded in the bank books so as to be credited to the banks assets when the state examiner made his visits he said. He has been connected with the bank for about fifteen years.
The mortgage was held by Ed J. Bredenburg, and was for $5,000. One of the notes for $2,500, had been given the bank for safe keeping by Nels Hockinson, and the other for $1,600, carrying the signature of Harry Nigh had been deposited by the Sders County Farm Loan Association.
Judge Hastings has ordered Galloway to make a full investigation of all transactions.
"I made no personal profit whatever from the transactions" Benson said when he pleaded guilty. "It was all done to save the bank."
Benson is married but has no children. He has been with the Citizens State bank ever since its founding about 15 years ago.
Fifteen counts have been listed in the federal complaint against Kirchman. The main charge is that he listed notes on the banks' books as owned by it, when they were actually the property of other banks.

    To Recall Grand Jury

A two-count indictment was also returned against Emil Benson, former Wahoo banker, charging him with misappropriation of $3,117 belonging to the Saunders County National Farm Loan association. Benson is serving a term in the Nebraska penitenty on bank charges.

THE LINCOLN STAR - THURSDAY, JUNE 25, 1931

    LUTHER COLLEGE SUIT SUSTAINED

SUPREME COURT AFFIRMS $10,000 JUDGMENT AGAINST BENSON

A $10,000 judgment obtained by the Luther college of Wahoo in a suit against Emil Benson, former treasurer of the college and his surety was affirmed by the Supreme court Friday. The college brought the action to recover from Benson and his sty, the American Surety company of New York, for sums alleged to have been converted by the treasurer to his own use as cashier and vice president of the Citizens State bank of Wahoo.
The defendants argued that, among other things, Benson's alleged manipulations of college funds deposited in the bank did not constitute embezzlement as defined by the statutes and consequently no liability on his bond was established, but thourt refused to adopt this theory.
"In a fidelity bond insuring an employer against loss sustained by any sort of embezzlement on the part of the employee, the word "embezzlement" is to be construed broadly in its general and popular sense, rather than in a narrow and technicapirit with specific references to the criminal statute of the state," the opinion stated.
The court also held that a bond guaranteeing fidelity of an employee is a form of insurance and subject to the rules applicable to insurance contracts generally, and not to the rules applicable to ordinary sureties for accommodation.

    UPHOLD TRUST FUND

In a Saunders county case, the Supreme court sustained a trust fund judgment of $7,050 obtained by Olaf Pearson, administrator of the estate of John Hulstedt, from the receiver of the Citizens State bank at Wahoo, one of the defunct Kirchmantitutions. The court found that Emil Benson, while guardian of Hulstedt, and cashier of the bank, fraudulently disposed of his ward's property and converted it the bank's use.

    BENSON BECOMES A TRUSTY

Former Wahoo Banker to "Dress In" New Prisoners

He was given the place long held by Tom Kelley, who with his brother Roy, was freed on commutation of sentences for robbing a jewel salesman in Fremont in 1929. Benson will have charge of "dressing in" new prisoners and have various other dut.
Kelley entered the outside world with this statement: "I want to bury the past and live in the future. I am going to prove to the world a man can make good coming out of prison. The 945 men I am leaving behind expect me to make good. I shallt betray them."

    LINCOLN EVENING JOURNAL - MARCH 10, 1937

    BENSON APPEALS

Emil Benson, 53, former Wahoo banker who is now serving his second ten year sentence for using the bank to defraud, told the (parole) board that of the 30 Nebraska bankers who have received prison sentences he has served the longest time. Theerage, he said, was 2 1/2 years.

"I put all the money I had into the bank to keep it from closing," Benson told the board. "I lost it all and didn't profit one cent."
    B. O. Hendricks, Wahoo attorney, told the board that he was called to the Benson home and the banker told him that something was wrong at the bank and that he wanted to go to the pen because his family had promised to stand by him if he woulo the right thing. Hendricks said he notified the county attorney and helped prepare the information against the banker and then went with him to court where Benson pleaded guilty.
Since then, the attorney said, the banker's family has turned against him, he has lost all his property, and his wife secured a divorce.
Olaf Pearson, Wahoo, a brother-in-law testified that Benson did not profit personally by ony of the money used in the transactions. C. O. Bruce offered employment. Others to speak in Benson's behalf were, Fred Hall, Carl Goucher, Wahoo, J. B.omas, W. H. Frost. Letters are on file from E. B. Perry and Walton B. Roberts urging his release.
Clemency was opposed in letters from Sheriff Mengel and Co. Atty. Hood. Hood charged that Benson did not co-operate in aiding the settlement of the affairs of the bank.

Interment was held the following Friday morning at the Lutheran Church Cemetery. Appropriate and impreve services were held with the Pastor of the church officiating, assisted by the remarks of Rev. Swanbom and Rev. Erlander, Ruth's grandpa. A beautiful song was sung by the Sunday School of which Ruth was a member. Gust Peterson of Concord, Nebraska, rendered "Face to Face."
Ruth's sweet disposition won her many friends and during her long illness, showed remarkable patience and all who came to see her were greeted with an affectionate smile. During her sickness she often remarked and thought of the heavenly homeat is prepared for the Christian Children. The regard for Ruth was plainly shown in the number of floral gifts presented and the expression that Ruth was literally buried in flowers may truly be used in this instance. The following relatives coming from a distance were: Mr. and Mrs. Gus Peterson, Concord, Mr. and Mrs. Alfred Felber, Laurel, Clemens Erlander, Anoka, Minnesota, Rev. Erlander and daughter, Teckla. REMEMBRANCES FROM FERN:

There is no other church like Grace (Swedeburg). My father helped install the bell. I remember they installed it on a Saturday. How they did that back then, getting it way up there. . .
Those wonderful stained glass windows - every time you look at them, they bring back memories.
I remember one time they had to open the doors (North wall of the Sanctuary) because they had so many people in church.
When I was in Confirmation class, we had to take our sermon notes in Swedish. That is until the war came, and we could only use one language.
My mother used to say how Aunt Ellen was such a wonderful coo
We lived down the hill from Uncle Will and Aunt Ellen and used to climb over the fence and go up and play at their place. I think we saw each other every day.
When your Grandmother (Florence) and I talk, we sure do a lot of remembering and talking about when we were growing up.

The confirmands were then subjected to a thorough examination in the doctrines and teachings of the Lutheran church. After the examination which lasted an hour and a half they sang "I am a Pilgrim" whereupon they gave their confirmation vows and were blessed. The pastor then presented each with a Bible, a gift from the congregation.
Those confirmed were Violet Anderson, Edna Pearson, John Walin Jr., Clemens Brodd, Reuben Isacson and Arvid Erickson.
Confirmation day is an annual event in the Lutheran church. The senior class in the Sunday school after having had intense instruction for almost a year under the pastor himself is on that day admitted into full membership of the church, theminating celebrating of the Lord's supper of which they then
    for the first time partake.

The bereaved wife told us the other day that a hard word had never been spoken in their home. This makes the passing all the harder. We sympathize with the sorrowing. Notes:

Linus was born on his grandfather's farm, where his parents were living at the time. When he was about one year old, the family moved from the farm to a small house in Swedeburg, where they lived for a couple of years. The family moved baco the farm after Augustinus inherited it in 1912. Linus went to a one room elementary school near the farm for grades 1 through 8, and next attended grades 9 and 10 in Swedeburg. To finish high school, he then went to Luther Academy in Wahoo for two years. Linus spent his non-school time doing farm work. Mildred was born on her parents' farm. She went to a two room elementary school in Swedeburg for 10 years. She went on to attend the high school in Wahoo for the next two years, and graduated from that school. During her two years at the high school, she boarded with families in Wahoo from Monday through Friday and returned to her folks' farm near Swedeburg for weekends. To pay her board the first year in Wahoo, MMildred baby-sat and ironed for her host family. In addition, her parents provided that family with butter, eggs, and cream. During her last year in high school, Mildred's parents paid her board with that year's host family. After she graduated, she moved back to her parent's farm. She spent most of the winters for the next nine years working as a domestic for families in Omaha. The rest of the time, she helped with the chores on her parents' farm.
Linus and Mildred knew each other since childhood, as their family farms were only about three miles apart. They went together for seven years before they were married.
Linus was a farmer for his entire working life; Mildred was a housewife. Beginning a couple of years before their marriage, Linus farmed on some land he rented and raised livestock. After they were married, they moved to a farmhouse one mil west of Linus' parents' farm. Around this time, Linus began to farm his parents' land. In the fall of 1936, Linus' parents moved from the family farm to Ceresco; Linus and Mildred moved to the family farm where they lived for more than forty years.
Linus' father Augustinus had inherited the family farm debt free in 1912. Augustinus did not actively farm after 1912 and mortgaged the land over the years. After Linus began to manage the family farm in 1936, Augustinus was able to reducee mortgage substantially, using the income generated from the harvests. Corn and soybeans were the main crops grown, and occasionally milo and winter wheat. The farm was almost paid off when Augustinus and Hermanda died in the late 1940s. Durinng the next 20 years or so, Linus gradually bought out the equity of his brothers and sisters. At various time, Linus also had livestock, buying and raising calves until they were ready for slaughter. Linus and Mildred added to the home farm's 200 acres by buying an additional 40 acres in the 1960s. Their three children attended elementary school at a one room schoolhouse, which was a short walk from the family farm. At one time, the school teacher boarded at the farm.
Shortly after he took over management of the farm, Linus became concerned about the amount of soil in the fields that was regularly washed away. To reverse this loss, he tried contour farming. Although helpful, this technique did not ret with the full soil conservation he desired. His pursuit of effective conservation continued and he attended a demonstration on terracing, a new concept in farming. At this demonstration, he saw that terracing protected contour farming by coconserving soil and moisture. He began to construct terraces on the farm in 1945. He found that terracing along with contour farming kept the silt from washing away. He proceeded to protect all the fields with terraces and waterways, and farmemed on contours parallel to the terraces. In recognition of his pioneer efforts in terrace farming, the Saunders County Soil and Conservation District gave the family the Conservation Farm Family award in 1964. The Omaha Herald also recognized Linus' conservation efforts.
In the fall of 1941, Linus purchased a modern corn picker. He wasn't sure if he could really afford this purchase. His father-in-law and brother-in-law, C. O. and Norm Pearson, who jointly farmed nearby, agreed to buy a share of the corn pir. World War II began a couple of months later and the manufacturing of all farm equipment was suspended. The acquisition of the picker prove to be a wise investment and the envy of the neighboring farmers.
Except for the years Linus' brother Joe spent in the Army in World War II, Joe lived on the farm until he was married. Their brother Loyd also lived on the farm except for the time he spent in the Navy during and shortly after the War. Mild prepared meals, washed clothes, and kept house for the entire family. Linus and Loyd farmed jointly and usually worked around 700 acres - the home farm plus land they rented. After Joe was married, he and his family lived on their Uncle Herman's farm just west of the home farm and the brothers often farmed together.
Early in his farming career, Linus saw the economic advantages of farmers working cooperatively, and became active in the Ceresco Farmers Co-op. In the early stages, the Co-op purchased large quantities of fuel for its members at a rate lessan what the farmers would pay individually. Linus later joined the Wahoo Co-op and the Saunders County Co-op. He was active in all three Co-ops simultaneously. It was said that Linus did not talk very much at meetings, but his input was always worth listening to. He served on the Board of all three Co-ops and for several years was the chairman of the Wahoo Co-op. Under his leadership, the Wahoo Co-op expanded significantly. In addition to fuel, the Co-ops purchased fertilizer, seed, and other farm supplies and equipment.
When the children were growing up, family activities usually involved visiting relatives. Often on Sundays, they drove to Omaha to visit Linus' sister Nellie Ann and her family. At Easter, they would drive to Oklahoma and stay with Linus'ter Bernice and her family. During the 1950s, the family spent several summer vacations at a lake in Minnesota.
As with most farms during the 1930s, a series of droughts took their toll and there were several lean years. The crops were generally very good in the 1940s. During some bad farming years in the 1950s, Linus worked in construction in Lincolnd Mildred worked for a short time at a hospital in Wahoo. Weather in the 1960s was mixed and there was a crop failure in 1970. Around that time when Linus thought about retirement, he was concerned on how they would make it financially, as the farm was still mortgaged. He felt that he might have to find some part time work after he retired from farming. As things turned out, the early 1970s brought a few years of excellent weather and high crop prices. Linus was able to retire in 1974, with the farm completely paid for. He even bought a new car. Linus and Mildred lived at the farm for four more years. Shortly after Linus retired, Loyd married and moved to Wahoo. Linus kept up a large vegetable garden as a retiremenment project. Linus and Mildred sold the farm house with 10 acres of land in 1978, and bought and moved into a house in Ceresco. They kept the farmland, which Loyd farmed until he retired. Then Mildred's nephew Kent took over farming the land. Mildred continued to live in the Ceresco house after Linus died in 1982, and moved to a rest home in Wahoo where she has lived since 1996.
Beginning in the early 1970s, Linus and Mildred spent the Christmas seasons in California with their children, Jack and Ann, and their families. Lee would usually join them there. Most of the time, Linus and Mildred drove on these trips.y usually went through Arizona where they visited Linus' sister Nellie Ann, and stopped in Oklahoma to visit another sister Bernice and her family. They liked to travel and do different things when they came to California. They enjoyed site seeing and going out to restaurants. For several years, Linus, Jack, and Randy went deep sea fishing during the annual visits. After Linus died, Mildred continued to spend Thanksgiving and Christmas in California for several more years.
Linus and Mildred were both quiet and reserved people. They had mild temperaments and did not complain about things. They were both sociable and liked to talk to relatives, friends, people they had just met or even to strangers. They werery devoted to their family. Like his father, Linus read a lot and could discuss a variety of subjects. He read books, magazines, and newspapers, and also liked to do crossword puzzles. He enjoyed watching baseball games on television. Mildred was an excellent cook and dedicated farm wife. She liked to crochet. At one time, she was an officer in the Saunders County Good Neighbors Extension Club. They were both active members of Grace Lutheran Church, a church that Linus' grandfather co-founded. Linus served as church deacon and for many years was the treasurer of the Church's cemetery. Mildred was active in the church's women's group, serving in various officer posts, including president and secretary.
